01 Agreement to Terms

By accessing or using ZenVPS services at zenvps.net (“Service”), you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, you may not use our Service.

“ZenVPS,” “we,” “us,” and “our” refer to ZenVPS and its operators. These Terms apply to all visitors, customers, and users.

02 Services Provided

ZenVPS provides Virtual Private Server (VPS) hosting services, including but not limited to:

• Linux and/or Windows VPS instances with allocated CPU, RAM, and NVMe SSD storage.
• Full root/administrator access to provisioned servers.
• Network bandwidth and connectivity.
• Optional domain name registration and management.
• Customer support via our designated support channels.

We reserve the right to modify, suspend, or discontinue any aspect of the Service with reasonable notice.

03 Account Registration

To use our Service, you must:

• Be at least 18 years of age.
• Provide accurate, current, and complete registration information.
• Maintain the security of your account credentials.
• Promptly update your information if it changes.
• Notify us immediately of any unauthorized account access.

You are responsible for all activities conducted through your account.

04 Payment & Billing

All payments are processed securely through Stripe, Inc. By providing payment information, you authorize ZenVPS to charge your payment method for all applicable fees.

• Billing Cycle: Services are billed monthly or as stated at the time of purchase.
• Renewal: Subscriptions renew automatically unless cancelled before the renewal date.
• Pricing: All prices are displayed on our Pricing page and are subject to change with 30 days notice.
• Taxes: You are responsible for any applicable taxes in your jurisdiction.
• Failed Payments: Services may be suspended after repeated failed billing attempts.
• Refunds: Please refer to our Refund Policy for full details.

05 Acceptable Use Policy

You agree to use ZenVPS services only for lawful purposes. You are solely responsible for all content, data, and activities on your VPS. Permitted uses include web hosting, application hosting, development environments, database servers, game servers, and personal VPN services in compliance with applicable laws.

06 Prohibited Activities

• Sending unsolicited bulk email (spam) or operating spam-related services.
• Hosting, distributing, or transmitting illegal content including CSAM.
• Conducting DDoS attacks or participating in botnet activity.
• Unauthorized port scanning, network probing, or hacking of third-party systems.
• Hosting phishing sites, malware, ransomware, or other malicious software.
• Cryptocurrency mining that violates resource limits or our Fair Use Policy.
• Violating intellectual property rights, including software piracy.
• Operating services that facilitate illegal activities in any jurisdiction.
• Reselling or subletting ZenVPS resources without prior written authorization.
• Any activity that disrupts ZenVPS infrastructure or other customers.

We cooperate fully with law enforcement regarding illegal activities conducted through our services.

07 Service Availability & SLA

ZenVPS targets 99.9% network uptime for its infrastructure. This excludes scheduled maintenance windows, customer-side misconfiguration, force majeure events, and third-party service failures outside our control.

Uptime credits, if applicable, are issued at our discretion and do not exceed the monthly fee for the affected service.

08 Suspension & Termination

ZenVPS reserves the right to suspend or terminate your account immediately for violations of the Prohibited Activities section, after notice for non-payment, for repeated violations of these Terms, or if required by law.

Upon termination, your data on the VPS may be deleted. You are responsible for maintaining your own backups. You may cancel your account at any time through your client portal.

09 Intellectual Property

The ZenVPS website, branding, and content are the intellectual property of ZenVPS and protected by applicable copyright and trademark laws. You retain ownership of any content or data you store on your VPS.

10 Limitation of Liability

To the maximum extent permitted by law, ZenVPS shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, or data. Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

11 Indemnification

You agree to indemnify and hold harmless ZenVPS and its affiliates from any claims, liabilities, damages, and expenses arising from your use of the Service in violation of these Terms, content on your VPS that infringes third-party rights, or your violation of any applicable law.

12 Governing Law

These Terms shall be governed by applicable international law and the laws of the jurisdiction in which ZenVPS operates. Disputes shall be resolved through binding arbitration or the appropriate courts, as applicable.

13 Changes to Terms

We may update these Terms at any time. We will provide at least 14 days notice of material changes via email or website notice. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
